These Terms of Service ("Terms") govern your access to and use of the Ezaris websites and applications (the "Service"). By creating an account or using the Service, you agree to these Terms. The Service is operated by Vital Systems, a proprietorship registered in India ("Ezaris", "we", "us").
You must be authorised to act for the business you register, and be of legal age to enter a contract. The person who creates a company account ("Admin") is responsible for the account and for the users they add.
You are responsible for keeping login credentials secure and for all activity under your account. Tell us promptly at support@ezaris.co if you suspect unauthorised access.
You agree not to misuse the Service, including by: enrolling a person's face without their knowledge and consent; using it to unlawfully surveil individuals; attempting to breach security or access other tenants' data; reselling the Service without authorisation; or using it for any unlawful purpose. You are responsible for obtaining any employee consents your local law requires.
You (and your employer) retain ownership of the data you put into the Service. You grant us the limited rights needed to host and process that data to provide the Service. We process personal data as described in our Privacy Policy.
Attendance features rely on face verification and location captured at the moment of a punch. Enrolled face templates are retained only while a person is an active team member; punch selfies are deleted after 30 days. You are responsible for informing your employees of this and obtaining any required consent.
We work to keep the Service available and reliable, but it is provided "as is" and we do not guarantee uninterrupted or error-free operation. We may perform maintenance and update features over time.
The Service uses third-party infrastructure (including Amazon Web Services and Google Maps). Your use of those features may also be subject to the third parties' terms. We are not responsible for third-party services outside our control.
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or unlawful use. On termination, we handle your data as set out in the Privacy Policy.
To the maximum extent permitted by law, we disclaim all implied warranties. Ezaris is a tool to assist with attendance and expense management; you remain responsible for your own payroll, tax, and employment decisions.
To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential losses.
You agree to indemnify us against claims arising from your misuse of the Service or breach of these Terms, including your failure to obtain required employee consents.
These Terms are governed by the laws of India, and the courts at our registered place of business shall have jurisdiction, without prejudice to any mandatory consumer protections available to you locally.
